In filing a divorce in the court of Atlanta, it is required that the spouse who is seeking the divorce is a resident of the state for 6 months or 180 days. The spouse must show a legal and acceptable evidence that he of she has lived in the state for this length of time.
To attempt seeking a divorce, the spouse must first file a Summons and Petition to the court. The court then will send A Summons to the other party, notifying that a divorce against him/her was sought and he/she has the responsibility to send a reply as a response to the said legal document. After this, the creation of a Petition follows, a document that comprehensively states the grounds of the spouse to seek a divorce, and the things that the spouse wants to obtain if ever the divorce is granted.
Divorces in Atlanta can be granted as early as 30 days after the date of filing. This short period, however, only applies to couples wherein both parties agree to terminate the relationship and settle all their legal issues. The constant factors that delay the grant of divorce are issues regarding child custody and visitation, alimony and spousal support, and division of assets and properties.
